- Telephone Consumer Protection Act (TCPA). Calls to mobile phones using an automated system or an artificial or prerecorded voice need the person's prior express consent, and this applies to business contacts' mobile numbers too.
- AI voices. In February 2024, the FCC ruled that AI-generated voices count as "artificial or prerecorded voice" under the TCPA, so AI voice calls follow the same consent, caller identification and opt-out rules.
- Do Not Call. The National Do Not Call Registry protects consumers' numbers. Business lines are generally not covered, but a business contact's personal mobile number may be. Keep your own internal do-not-call list and honor every opt-out.
- Business-to-business calls. The FTC's Telemarketing Sales Rule exempts most business-to-business calls, but the TCPA still applies to calls to mobile numbers.
- Calling hours. Telemarketing calls to residential numbers are limited to between 8 a.m. and 9 p.m. in the called person's local time.
European Union
GDPR applies to the personal data in your call lists and recordings, and many EU countries have national rules and opt-out registers for marketing calls. India
